These terms govern the services provided by iBACT Digital, including website design and development, app development, hosting, SEO, digital marketing, graphics, and related business services.
These are the standard terms and conditions for Website Design and Development, App Development, Hosting Service, Social Media Marketing, Google Ads Marketing, SEO Services, and Graphics Design works undertaken by iBACT Digital for its clients. The website and this business are owned by iBACT Digital.
We, including any subcontractors or re-sellers engaged by us, agree that we will not at any time disclose any of your confidential information to any third party.
A 50% deposit or advance payment of the total project cost payable under our proposal is due immediately upon you instructing us to proceed with the work. The remaining 50% becomes due when the work is completed to your reasonable satisfaction. We reserve the right not to commence any work until the deposit has been paid in full.
The 50% deposit or advance paid is non-refundable as we book the domain, hosting, and begin work on the project.
We are pleased to offer you the opportunity to make revisions to the design. However, we have the right to limit the number of design proposals to a reasonable amount and may charge for additional designs if changes are made to the original design specification.
Our website development phase is flexible and allows certain variations to the original specification. However, any major deviation from the agreed specification will be charged separately as a variation.
iBACT Digital provides free tier hosting for 1 month from the date of website development. During this free tier period, we develop and deliver the website. In rare scenarios, some projects may take more than 1 month to complete, and for such projects we may extend the free tier hosting until development is completed.
Example: If an order is placed on 01.01.2020, then the free 1 month hosting period will be available for up to 30 days, that is until 30.01.2020. Normally websites are delivered within 5 to 7 working days, so the free tier hosting may be used until the expiry date.
Our free hosting includes the plan iBACT Digital WH2 with 150 GB SSD Storage, 10 Domain Name, Unlimited Bandwidth, Unlimited Email Accounts, and cPanel access. Once the free tier hosting period is complete, you may renew the same plan or upgrade to another hosting plan available at iBACT Digital.
If you wish to host your website with another hosting provider, we allow migration during the free tier period. Once the free tier period is complete, you will need to renew and activate the cPanel before migration can be done.
Any time frames or estimates provided by us are contingent upon your full co-operation and the timely supply of complete and final content, photography, and other required materials.
During development, feedback is required in order to progress through subsequent phases. A single point of contact should be appointed from your side and made available on a daily basis to expedite the feedback process.
On completion of the work, you will be notified and given the opportunity to review it. You must notify us in writing of any unsatisfactory points within 24 hours of such notification.
Any work that has not been reported in writing as unsatisfactory within the 24 working hours review period will be deemed approved. Once approved, or deemed approved, the work cannot subsequently be rejected and the contract will be deemed completed. At that stage, the remaining 50% balance becomes due.
Upon completion of the 24 hours review period, we will invoice you for the remaining 50% balance of the project.
In case the client cancels the project without valid grounds and against the agreement, legal proceedings may be initiated as per Section 138 and 42A of the IT Acts, 2007.
Once you have paid us in full for our work, we grant to you a license to use the website and its related software and contents for the life of the website, provided regular renewal of subscription is done on or before the expiry of the term.
By default, we use PHP Framework – WordPress for website development.
Note: Up to 12 months from website development, you cannot transfer the website to another server company or server provider, and the data should remain within iBACT Digital servers as per EU Data Protections Act.
To the fullest extent permitted by law, all terms, conditions, warranties, undertakings, inducements, or representations whether express, implied, statutory, or otherwise, other than the express provisions of these terms, are excluded.
Where liability cannot be excluded by law, such liability is limited, at our option, to the replacement, re-repair, or re-supply of the services, or the payment of the cost of the services we were contracted to perform.
By using current versions of well-supported content management systems such as WordPress, we endeavor to ensure that the websites we create are compatible with current modern browsers including recent versions of Internet Explorer, Firefox, Google Chrome, and Safari.
Third-party extensions may not have the same level of support across all browsers. Where appropriate, we will substitute alternative extensions or implement other solutions on a best-effort basis.
iBACT Digital provides after-sales support including technical support, maintenance support, and customer assistance via support ticket, website live chat, and phone support.
Phone support and live chat are available from 9:00 AM to 9:00 PM (IST), Monday to Saturday. Support tickets are available 24 hours a day. To receive 24-hour support, you must log in to your iBACT Digital account and raise a support ticket. Our executives will reply as soon as possible.
You must supply all materials and information, including copyrighted content, required by us to complete the work in accordance with any agreed specification. Such materials may include photographs, written copy, logos, and other printed materials.
If delays in supplying these materials cause delays in completion, we reserve the right to extend any agreed deadlines by a reasonable amount.
If any content provided by you violates applicable copyright rules, including The Copyright (Amendment) Act, 2012, we may remove the content from the website without prior notice.
For ecommerce websites, payment gateway technical integration is provided free. However, approval from partner banks is not included in the integration, and gateway approval services cost Rs 4222/- extra, including approval, document preparation, and SDK support.
You must obtain all necessary permissions and authorities in respect of the use of all copy, graphic images, registered company logos, names, trademarks, or any other material that you supply to us for inclusion in your website or web applications.
You must indemnify us and hold us harmless from any claims or legal actions related to the content of your website.
We do not guarantee any specific position in search engine results for your website. We perform basic search engine optimization according to current best practices.
You are responsible for maintaining your own backups in respect of your website. We will not be liable for restoring any client data or client websites except to the extent that such data loss arises from a negligent act or omission by us.
We may book the domain name on your behalf. If at any point you wish to move away for any reason, we will process the transfer within a reasonable time, provided there are no outstanding dues.
Our transfer process is intended to be automated, fast, and risk-free, so that moving your domain or hosting files to another service provider happens mostly in the background and with minimal disruption.
The agreement constituted by these terms and conditions and any proposal shall be construed according to and governed by the laws of India only.
iBACT Digital may revise these Terms and Conditions of Services at any time as it deems fit. Orders taken prior to any update shall also come under the updated terms and conditions.
If you believe any changes may affect your project, you must notify us within 10 days of the terms being updated. By using this website, you are expected to review these terms regularly to ensure that you understand the rules governing use.
iBACT Digital is legally owned and managed by IBACT Digital. All legal communications shall be made to the legal owner of iBACT ventures.
